This website displays aggregated statistics on used car prices. The underlying data is manually collected from publicly accessible sources and processed into statistics.

Legal Framework

What We Do

  • Data Collection: We collect prices, model years, and mileage from publicly accessible vehicle listings
  • Aggregation: Raw data is processed into statistics (average prices, price ranges, trends)
  • Publication: We publish exclusively aggregated statistics, not individual listings

What We Do NOT Do

  • No circumvention of technical protection measures
  • No publication of individual listings or raw data
  • No processing of personal data (names, phone numbers, addresses)
  • No automated scraping or use of bots

Legal Assessment

Copyright Law

Pure factual data such as prices, model years, and mileage is not protected by copyright. Copyright protects creative works, not mere information.

Database Protection (Sui Generis Right)

Under EU law (Directive 96/9/EC) and German law (§§ 87a ff. UrhG), databases in which substantial investment has been made are protected. However, according to German Federal Court (BGH) case law:

  • Extraction of individual data points is permissible
  • Transformation into independent statistics constitutes separate work
  • Violation of terms of service alone does not constitute unfair competition

Relevant BGH Decision: In the "Automobil-Onlinebörse" ruling (BGH, June 22, 2011, I ZR 159/10), the German Federal Court held that merely querying data from car marketplaces does not infringe the database maker's rights, as long as no "substantial parts" of the database are copied.

Data Protection (GDPR)

Since we do not process personal data (only factual data about vehicles), the GDPR does not apply to our data collection activities.

Competition Law

According to BGH case law (I ZR 224/12 - Flight Booking), reading publicly accessible data for comparison purposes is generally permissible, provided that:

  • No technical protection measures are circumvented
  • Data is transformed rather than copied verbatim
  • The service promotes consumer transparency
